This wiki is administered by Ruby Dennington (Theleruby) on behalf of "Theleruby & Friends", an operating name of Ginever Entertainment. The operation of this wiki has been permitted under the terms of the Ginever Entertainment Project Contributor Agreement (Revised Second Edition) and by subsequently approved purpose validations.

In addition to being covered by the Terms of Use, all contributions to Intrypedia are subject to the Intrypedia licensing terms. The purpose of these terms is to protect Ginever Entertainment by ensuring that full control is retained over the intellectual property used within Ginever Entertainment projects, while simultaneously avoiding any liability that may otherwise have been created by people submitting unwelcome content.

Please be aware that all contributions to the wiki are expected to meet one of the following criteria:

  • They are original works by you, or works you have derived from other Ginever-operated wiki contributions
  • They are copied from a public domain or similar free resource
  • They are works of Ginever Entertainment and your submission of those works to this wiki is covered under fair use laws

In addition, the contributions are covered under the latest approved version of the Intrypedia licensing terms only. This means that if the terms which cover contributions to this wiki are changed, and the management panel has approved those changes, the new terms will immediately apply to all contributions made either by you or by other people, regardless of when those contributions were made.

By making a submission to the wiki, or by accessing its content, you permanently bind yourself to these terms. If you do not agree to these terms and to the retroactive application of newer versions of the terms, you should not submit any contributions to Intrypedia and you should not use, modify or share any contributions that have already been submitted.

The TLDR version (this is not a legal text):

Additional note regarding purposes as mentioned in section 2(a) of the Terms of Use

Since 21 December 2019 there are new PCA terms regarding use of unique content created for or intended for use by Ginever Entertainment. All such content is now subject to a purpose limitation, whereby the management panel must unanimously consent to which purposes content can be used for. In general, the consent and revocation of these purposes is subject to a legally validatable audit trail and must be signed off. This is intended as a safety precaution to try to protect Ginever Entertainment and its users/customers from hostile agressors who might potentially want to hijack content that wasn't created for or intended for use by them.

The purpose validation clause has now subsequently been applied to the Ginever-operated wikis in order to try to provide the same protections to wiki contributions as to content submitted using the PCA. For the sake of convenience and brevity, any content submitted to the Ginever-operated wikis may be used for purpose X as long as an equivalent contribution submitted under the PCA would also be usable for that purpose. This allows the PCA purpose validations to consequently also be applicable to wiki contributions.

Intrypedia licensing terms

1. PREAMBLE

For the purposes of these terms:

"Ginever Entertainment" or "Ginever" means an unincorporated association which was set up in November 2009 for the purposes of managing the Ginever.net website (previously known as "The Ginever Block.com") and which previously operated under the names "The Ginever Alliance" and "The Ginever Service Alliance". Since the closedown of Ginever.net in 2020, it now operates Theleruby.com under the name "Theleruby & Friends".

The term "management panel" means the following people and consists of the following members:

  • Ruby Dennington (Theleruby)
  • Paul Dennington (Paulicus25)
  • Trevor Sparks (Medessec)

The term "contribution" means any form of code, patch, tool, utility, artwork, audio, video, level, map, scene, prefab, animation, documentation, manual, specification, concept, idea or any other material which is submitted, posted, uploaded or transferred by you to Intrypedia.

2. GRANT OF RIGHTS BY CONTRIBUTORS

If you are registered with the wiki and your account is not blocked from accessing the service, you are hereby permitted to submit contributions to Intrypedia, subject to the limitations in section 4. For all submissions made by you (regardless of whether they are permitted or not), the following grant of rights applies:

(a) You hereby grant to the management panel a perpetual, worldwide, exclusive, non-transferable, royalty-free, irrevocable license granting the rights to include, use, reproduce, modify, display, perform, distribute, sell, make derivative works of and sublicense your contributions for any purpose, with rights to sublicense through multiple tiers of sublicensees, as long as that purpose is also considered valid for contributions submitted under the terms of the "Ginever Entertainment Project Contributor Agreement (Revised Second Edition)" as signed by all members of the management panel on Saturday 21 December 2019.

(b) With respect to any of the rights assigned to the management panel under section 2(a), you hereby further grant the management panel the non-transferable rights to engage in and pursue any remedy that would protect against or recover any damages caused to Ginever Entertainment by the misuse of your contributions by any third party (e.g. if your contributions are included in a video game which is then pirated, the management panel will be allowed to issue a copyright infringement takedown notice with respect to this piracy, and/or take the person pirating the game to court). Furthermore, you agree to allow the management panel to display a copyright notice in the style of "© Ginever Entertainment" (or effective equivalent) in or against any works which make use of the assigned rights and by which they may intend to protect against or recover any damages in this way.

(c) For patent claims including, without limitation, method, process, and apparatus claims which you own, control or have the right to grant, now or in the future, you grant to the management panel a perpetual, worldwide, non-exclusive, non-transferable, royalty-free, irrevocable patent license which, aside from being non-exclusive, covers and is subject to the same effective rights, terms and limitations as those laid out in section 2(a). This license is granted only to the extent that the exercise of the licensed rights infringes such patent claims.

(d) To the extent that any of the rights in sections 2(a), 2(b) or 2(c) cannot be licensed or granted by you to the management panel, you irrevocably waive and agree never to assert such rights against any member of the management panel, against Ginever or any of its successors in interest, or against any legal entity to which the management panel chooses to grant a sublicense to for your contributions.

3. USE, MODIFICATION AND REDISTRIBUTION OF CONTRIBUTIONS

For all contributions submitted to this wiki, the following applies:

(a) You are permitted to use the contributions for personal, non-commercial use, subject to the limitations in section 4.

(b) You are permitted to modify the contributions for the purposes of submitting those modifications to any Ginever-operated wiki, subject to the limitations in section 4.

(c) You are permitted to use, modify and redistribute the contributions as part of "customized software materials" for software products which are developed or published by Ginever Entertainment which authorize you to create "customized software materials" under their respective license terms, subject to the limitations in section 4.

(d) Any usage, modification or redistribution of the contributions not permitted under this section of the terms is prohibited.

4. LIMITATIONS

Your usage, modification, submission and redistribution of the contributions must not result in harm or damage to the members of the management panel in any way, either directly or indirectly. It is up to the discretion of the members of the management panel as to what constitutes harm or damage.

5. NO WARRANTY

The contributions are provided "as is", without warranty of any kind, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the contributions, or the use of other dealings in the contributions.

The views and conclusions contained in the contributions are those of the authors and should not be interpreted as representing official policies, either expressed or implied, of the management panel or of Ginever Entertainment.
